FTC Compliance on Product Reviews

On August 14, 2024, the FTC introduced new regulations that directly affect how businesses manage and incentivize product reviews.

 

What You Need to Know About Collecting Reviews on Cohley:

  • Soliciting reviews is still permitted
    However, the new regulations emphasize that offering a product in exchange for a review with a specific sentiment (e.g. requiring a positive review) is prohibited.
  • Action Recommended:
    We suggest reviewing your product review briefs to ensure that your language encourages creators to leave honest and genuine reviews, without implying any expectation for a specific sentiment.

For Example:

  • Don’t: Direct a reviewer to “Talk about how easy the vitamin is to take.”
  • Do: Suggest talking points like "Here are some aspects you can touch on in your review: Is it easy to take?"

How the product helps you stay compliant: 

  • All influencer and reviews briefs includes links to FTC guidelines for creators to review. 
  • Language ("I was given this product in exchange for my honest review.") is automatically included review brief textbox where creators type the review 
  • All reviews that are sent via the Bazaarvoice integration are badged as incentivized 
  • Please check your settings in Yotpo to ensure that reviews are being badged as incentivized
